PUBLIC NOTICE Notice is hereby provided pursuant to Sections 609(b)(1) and 610(a) of the Pennsylvania Municipalities Planning code, as amended, 53 P.S. §§ 10609(b)(1) and 10610 (hereinafter, "MPC"), that the Borough Council of the Borough of Catasauqua (hereinafter, "Council) will hold a public hearing on Monday, November 5, 2018, commencing at 7:00 P.M., at Borough Hall, located at 90 Bridge Street, Catasauqua, Pennsylvania, for the purpose of taking public comment and input concerning the adoption of an amendment to the Borough of Catasauqua Zoning Ordinance. The Ordinance updates regulations relating to the unified development standards for mixed-use development in the Waterfront Zoning District. Council will consider passage of the Ordinance at a public meeting on Monday, November 5, 2018, to be held immediately after the hearing and commencing at 7:00 P.M. at the Borough Hall located at 90 Bridge Street, Catasauqua, Pennsylvania. Copies of the Ordinance have been delivered to the Lehigh Valley Planning Commission for comment pursuant to applicable law. The following is a summary of the contents of the Ordinance, prepared by the Solicitor pursuant to Section 610(a) of the MPC, as amended, 53 P.S. §10610(a). The title of the proposed Ordinance is: "AN ORDINANCE AMENDING THE BOROUGH OF CATASAUQUA ZONING ORDINANCE BY AMENDING SECTION 280-80.B, RELATING TO UNIFIED DEVELOPMENT STANDARDS IN THE WATERFRONT (W) ZONING DISTRICT, TO CLARIFY AND CONFIRM THE INTENT THAT THE LAYING OUT OF STREETS, WHETHER PUBLIC OR PRIVATE, IN A PROPOSED, MIXED-USE DEVELOPMENT DOES NOT WITHOUT MORE CREATE A "LOT" AS THAT TERM IS OTHERWISE DEFINED IN THE ZONING ORDINANCE." The Ordinance contains a statement of legislative findings and a savings clause and repeals inconsistent ordinances. It becomes effective upon enactment and mayoral approval, or as otherwise specified in the Borough Code. The Ordinance amends Zoning Ordinance Section 280-80.B, relating to unified development standards, to provide that the laying out, design or construction of public or private streets as part of mixed-use development in the Waterfront Zoning District does not, in and of itself, create lots or constitute a subdivision of land.
